Alternative Dispute Resolution, or ADR, can enable the parties to a dispute obtain a fair and just result without the need for a time-consuming and costly trial.

ADR usually consists of mediation or arbitration.

Mediation is non-binding — the parties come together before a neutral person who listens to and interacts with all sides. The mediator lets all sides vent and express their opinions about the matter. During this process the mediator identifies what each party considers important and critical to its interests, and explores options for a mutually acceptable resolution. Through this process, the mediator attempts to enlighten the sides enough so that they agree on their fate rather than having it decided for them by a jury.

Arbitration is usually binding — the parties trade a jury for an arbitrator or panel of arbitrators whom they have chosen. These arbitrators are experienced professionals who hold themselves to the highest standards of impartiality and justice. Each party is represented by an attorney who attempts to make a persuasive case on behalf of the client, based on the facts of the matter and the law. The presentation to the arbitrators is usually quicker, simpler, less expensive, and more focused than a jury trial. Decisions are handed down rapidly and appeals are rare.
